A Saudi young woman in her 20s got divorced as her husband sent her an SMS text from Iraq saying he had divorced her. The message was sent from Iraq where the husband say is staying for the purpose to participate in “jihad,” Further more husband called two of his friends who has witnessed the wedding and told them that he has sent SMS text message to divorce his wife.
The Judge who is taking this case summoned those two friends and two relatives of the absent husband and confirmed from them as that the marriage was divorced by the husband.
The judge approved the divorce and told the woman that she did not have to go through the iddah (the post-divorce waiting period stipulated by the Shariah) as the marriage was not consummated.
