Sri Lanka SMS messages can be produced as evidence in court according to news published in the Sri Lanka's leading news paper Sunday times. According to the news report a High Court Judge has accepted them as admissible evidence in a case. The message will not fall into the category of primary evidence under Section 63 of the Evidence Ordinance, but will fall into the secondary evidence.
Further more he said that SMS texts could be accepted under the Electronic Transactions Act, and that it extended to images appearing on any substance such as a computer screen, according to the circumstances of each case.
So, the users of SMS in Sri Lanka must take care not to send messages to unknown people and when sending messages to their friends or relatives they must take care as it may lead them to courts if the other party is offended by the content.
The message will not fall into the category of primary evidence under Section 63 of the Evidence Ordinance, but into that of secondary evidence.
